TERMS AND CONDITIONS OF SERVICE

RZR Electrical Services

These Terms and Conditions (“Agreement”) constitute a binding legal agreement between RZR Electrical Services (“Company,” “we,” “us,” or “our”) and the customer (“Client,” “you,” or “your”) receiving services, equipment, or materials. By authorizing RZR Electrical Services to perform work, you agree to be bound by these terms.

1. Scope of Work and Authorizations

\nDetailed Estimates: Work will be performed as specified in the written estimate, proposal, or invoice provided to the Client.
\nModifications & Change Orders: Any deviations, additions, or changes involving extra labor or materials will be executed only upon written or verbal authorization from the Client. These will become an extra charge over and above the original estimate.
\nPermits and Inspections: Company will secure necessary regulatory permits required for the scope of work. Client agrees to cooperate with local municipal inspectors to allow access for final inspections.

2. Client Responsibilities

\nUnmitigated Access: Client must provide unmitigated access to the work area during scheduled service hours. [1]
\nPower Source: Client must provide accessible electricity (such as a functional live outlet or generator within 150 feet of the work area). [1]
\nStructural Hazards: Client must inform the Company of any known hazardous conditions, concealed structural defects, or dangerous materials (e.g., asbestos) prior to commencement.
\nProperty Insurance: Client agrees to maintain comprehensive dwelling and property insurance during the duration of the project. [1]

3. Payment Terms

\nPayment Due: Payment is due in full upon completion of the specified work unless prior written financing or milestone agreements are established.
\nLate Fees: Past due balances are subject to a late service charge of 1.5% per month (18% per annum) or the maximum rate permitted by law, whichever is lower.
\nCollection Costs: Client agrees to pay all costs of collection, including reasonable attorney fees and court costs, should legal action be required to secure payment.
\nRetention of Title: Title to all goods, parts, and materials installed transfers to the Client only upon payment in full. Unpaid goods remain the property of the Company, and the Company reserves the right to remove unpaid equipment to the extent permitted by law. [1]

4. Warranties and Limitations of Liability

\nWorkmanship Warranty: Company provides a twelve (12) month warranty on workmanship and technical defects from the date of completion.
\nManufacturer Warranties: Warranties for materials and equipment (e.g., fixtures, panels, breakers) are strictly provided by the respective manufacturers and are not extended by the Company.
\nExclusions: This warranty does not cover damage caused by abuse, negligence, unauthorized modifications, force majeure (acts of God), or normal wear and tear. Sitework, drywall patching, painting, demolition, and debris removal are excluded unless explicitly itemized in the scope of work.
\nLimitation of Liability: To the maximum extent permitted by law, Company's total liability for any claims, losses, or damages arising out of this Agreement shall not exceed the total amount paid by the Client to the Company for the specific services rendered. [1]

5. Multi-State Governing Law and Jurisdiction

\nGoverning Law: This Agreement shall be governed by, construed, and enforced in accordance with the laws of the Commonwealth of Virginia for work performed in Virginia, and the laws of the State of Maryland for work performed in Maryland.
\nVenue: Any legal action, dispute, or proceeding arising under this Agreement shall be brought exclusively in the state or federal courts located in the county where the services were physically performed.

6. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
